1. Acceptance of Terms

These Terms of Service (‘Terms’) form a legally binding agreement between you (‘you’, ‘user’, ‘member’) and MANLY HEALTH, a sole proprietorship business operating the website manlyhealth.in (‘Platform’, ‘we’, ‘us’, ‘our’).

By accessing our website, booking a consultation, enrolling in a wellness program, or purchasing any product from us, you confirm that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, Shipping Policy, and Return and Refund Policy, each of which is incorporated into these Terms by reference.

If you do not agree with any part of these Terms, you must not use our Platform or services.

2. Eligibility

Our services are intended exclusively for men aged 18 years or older. By using our Platform, you confirm that you are at least 18 years of age and that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

We reserve the right to request proof of age or identity at any stage, and to refuse or discontinue service if we reasonably believe this eligibility conditions are not met.

3. Nature of Our Services

MANLY HEALTH provides doctor-led Ayurvedic consultations, clinical psychology support, personalised wellness programs, and related Ayurvedic products, designed for general health and wellness purposes.

All consultations are conducted by doctors and clinical practitioners directly engaged by MANLY HEALTH. We do not operate as a referral platform for unaffiliated or third-party practitioners.

Our services and products are intended to support general wellness. They are not a substitute for emergency medical care, hospital treatment, or specialist medical intervention, and they are not intended to diagnose, treat, cure, or prevent any disease.

If you are experiencing a medical emergency, you must seek immediate care from a hospital or emergency service. Do not rely on our Platform for emergency medical needs.

4. Account Registration

You may be required to provide accurate and current information when booking a consultation or creating an account, including your name, contact details, and relevant health information.

You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activity that occurs under your account.

You agree to notify us immediately at support@manlyhealth.in if you become aware of any unauthorised use of your account.

5. Consultations and Wellness Programs

Consultations are scheduled subject to doctor availability. We will make reasonable efforts to accommodate your preferred time slot but do not guarantee availability at any specific time.

The personalised wellness plan, dietary guidance, or product recommendation provided to you is based on the information you disclose during your consultation. The accuracy and effectiveness of this guidance depends on the completeness and honesty of the information you provide.

You agree to disclose your relevant medical history, current medications, and pre-existing conditions truthfully. We are not responsible for any adverse outcome arising from incomplete, inaccurate, or withheld information provided by you.

Outcomes of any wellness program vary from person to person. We do not guarantee specific results, timelines, or outcomes from any consultation, program, or product.

6. Payments

All fees for consultations, programs, and products must be paid in full at the time of booking or purchase, through our designated payment partner.

All fees paid to MANLY HEALTH are non-refundable, except as expressly set out in our Return and Refund Policy. By making a payment, you acknowledge and accept this condition.

We reserve the right to revise our pricing at any time. Any revision will not affect a booking or order that has already been confirmed and paid for.

7. Products

All Ayurvedic products sold on our Platform are manufactured in accordance with applicable Indian manufacturing standards. Product use is subject to the instructions provided with the product and any guidance given by your consulting doctor.
You agree to inform your doctor of any known allergies, sensitivities, or pre-existing conditions before using any product recommended to you.
Shipping and delivery of products is governed by our separate Shipping Policy.

8. User Conduct

You agree to use our Platform only for lawful purposes and in a manner consistent with these Terms. You agree not to:

Provide false, misleading, or fraudulent information during registration, consultation, or checkout

Use our Platform to harass, abuse, or threaten our staff, doctors, or other users

Attempt to gain unauthorised access to our systems, accounts, or data

Copy, reproduce, or redistribute any content from our Platform without our written permission

Use our Platform for any purpose that violates applicable Indian law

We reserve the right to suspend or terminate your access to our Platform if we reasonably believe you have violated this Section.

9. Intellectual Property

All content on manlyhealth.in, including text, graphics, logos, product names, programme structures, and design elements, is the property of MANLY HEALTH and is protected under applicable Indian intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent.

10. No Warranties

Our Platform, consultations, programs, and products are provided on an ‘as-is’ and ‘as-available’ basis. To the maximum extent permitted under Indian law, we make no warranties or representations, express or implied, regarding the outcome, effectiveness, or suitability of our services for your specific circumstances.
We do not warrant that our Platform will be uninterrupted, error-free, or free from technical issues, although we take reasonable steps to maintain its proper functioning.

11. Limitation of Liability

To the fullest extent permitted under applicable Indian law, MANLY HEALTH, its proprietor, employees, and engaged practitioners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, emotional distress, or any future or ongoing damages, arising out of or in connection with your use of our services, consultations, programs, or products.

Our total liability to you for any claim arising from these Terms, regardless of the cause of action, shall not exceed the total amount actually paid by you to MANLY HEALTH for the specific service or product giving rise to the claim.

Nothing in this Section is intended to exclude or limit any liability that cannot be lawfully excluded or limited under the Consumer Protection Act, 2019, or any other applicable Indian law, including liability arising from proven medical negligence or wilful misconduct.

You agree to indemnify and hold harmless MANLY HEALTH, its proprietor, employees, and engaged practitioners from and against any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of our Platform, or any false or misleading information you provide to us.

13. Termination

We reserve the right to suspend or terminate your access to our Platform or services, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused our services.
You may discontinue use of our services at any time. Termination of your account does not entitle you to a refund of fees already paid, except as set out in our Return and Refund Policy.

Your use of our Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health information in compliance with the Digital Personal Data Protection Act, 2023.

15. Changes to These Terms

If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the competent courts and consumer forums located in New Delhi, India.
